3. Purchases

General Terms When you opt to purchase any product or service made available through our Service ("Purchase"), you will be required to provide specific information pertinent to facilitating that transaction. This information may include your credit card details, its expiration date, your billing and shipping addresses, and other relevant data.

Payment Verification and Authorization You hereby affirm and guarantee that: (i) you have the legal authorization to use any credit cards or other payment methods connected with any Purchase; and (ii) the information you provide is accurate, complete, and up-to-date. Digital Maestro Pte. Ltd. relies on third-party services to facilitate payments and to fulfill Purchases. By offering your information, you grant us permission to share this information with these third-party services in compliance with our Privacy Policy and Singapore's PDPA regulations.

Right to Refuse or Cancel Orders We reserve the exclusive right to decline or cancel your order at any point in time for various reasons. These reasons may include, but are not limited to, product or service availability, pricing or description errors, or other factors. Additionally, we reserve the right to refuse or cancel your order if we suspect fraudulent, unauthorized, or illegal transactions.

Order Confirmation and Status Updates Once your order is confirmed, you will receive an email confirmation summarizing your Purchase. You will also receive periodic updates about the status of your order and tracking information, where applicable.

Currency and Tax All transactions are processed in Singapore Dollars (SGD). Prices listed on our Service are inclusive of Goods and Services Tax (GST) as applicable in Singapore, unless otherwise stated.

Return and Refund Policy Digital Maestro Pte. Ltd. offers a return and refund policy compliant with the Consumer Protection (Fair Trading) Act of Singapore. The specific terms and conditions of returns and refunds will be indicated on the respective product or service description page.

Export Control Laws Products purchased or received under these terms and conditions shall be subject to export laws and regulations of Singapore. You agree to comply with all applicable export and re-export restrictions and regulations and to not transfer, or authorize the transfer, of products to prohibited countries or otherwise in violation of any sanctions programs.

Legal Compliance and Repercussions Any attempt to manipulate or exploit our system for unauthorized purchases will be dealt with severely, and may lead to legal action in accordance with Singapore's Computer Misuse Act and other applicable laws.

Scope of Promotions Digital Maestro Pte. Ltd. may, from time to time, introduce various promotions, sweepstakes, contests, and special offers (collectively referred to as "Promotions") via our Service. These Promotions may offer perks, discounts, or exclusive access to our products and services.

Eligibility Criteria Participation in any Promotion is subject to eligibility criteria set forth in the specific terms and conditions for each Promotion. Unless otherwise indicated, Promotions are only available to users who are 18 years of age or older and are residents of Singapore.

Promotional Rules and Guidelines Each Promotion is governed by specific rules and terms that will be clearly outlined for participants. These rules may include the duration of the Promotion, eligibility criteria, and any other information or requirements necessary for participation. It is your responsibility to read and understand these rules before participating in a Promotion.

Interaction with Terms of Service In case of any conflict between these Terms of Service and the rules of a specific Promotion, the Promotion rules will prevail to the extent of the inconsistency, but all other terms in this Terms of Service will continue to apply.

Awarding of Prizes and Incentives For Promotions that involve the awarding of prizes or other incentives, winners will be chosen through a process outlined in the specific Promotion rules. Winners may be required to participate in a prize-giving ceremony and may be asked to provide a testimonial for promotional purposes.

Tax Implications Any prizes or incentives received through Promotions may be subject to tax liabilities, as per the Inland Revenue Authority of Singapore (IRAS) guidelines. It is your responsibility to report such earnings and pay the relevant taxes accordingly.

Data Protection and Privacy Information collected through participation in a Promotion will be processed in accordance with our Privacy Policy and applicable Singapore laws, including the Personal Data Protection Act (PDPA).

Cancellation and Amendments Digital Maestro Pte. Ltd. reserves the right to cancel, amend, or suspend any Promotion at its sole discretion, subject to applicable laws in Singapore and provided reasonable notice is given.

Liability and Indemnification By participating in any Promotion, you agree to release and hold harmless Digital Maestro Pte. Ltd., its subsidiaries, and its employees from any and all liability or any injuries, loss, or damage of any kind arising from or in connection with the Promotion.

5. Subscription Services

Types of Subscriptions Digital Maestro Pte. Ltd. offers various subscription-based services ("Subscription Services"). These could range from access to premium features, specialized analytics, or advanced customization options.

Billing Cycle Subscriptions are billed either monthly or annually, depending on the plan you choose ("Billing Cycle"). Your Subscription will automatically renew at the end of each Billing Cycle unless you cancel it prior to the renewal date.

Payment Information A valid payment method, such as a credit card or other permitted payment method, is required for Subscription Services. You agree to provide accurate, current, and complete billing information and authorize Digital Maestro Pte. Ltd. to charge the applicable fees to your chosen payment method.

Cancellation Policy You may cancel your Subscription at any time before the next Billing Cycle to avoid future charges. Cancellations can be done through your online account management page or by contacting our customer support at support@digitalmaestro.com.

Non-payment and Remedial Actions Should payment not be successful, an electronic invoice will be sent, requiring manual payment within a stipulated deadline. Failure to meet this payment deadline may result in the suspension or termination of your Subscription Services.

Data Retention and PDPA Compliance Upon cancellation or termination of your Subscription, we will retain your data in compliance with Singapore's Personal Data Protection Act (PDPA) and our Privacy Policy.

Changes to Subscription Fees Digital Maestro Pte. Ltd. reserves the right to modify Subscription fees. Any changes will be communicated with reasonable notice, allowing you to cancel your Subscription should you not agree with the new fees.

Refund Policy Refunds for Subscription Services are only available within seven (7) days of the original purchase, in compliance with Singapore's Consumer Protection (Fair Trading) Act.

6. Free Trial Period

Availability and Eligibility Digital Maestro Pte. Ltd. may offer a free trial period for certain Subscription Services ("Free Trial"). The Free Trial is available only to new users who have never subscribed to the particular service before, and its duration will be specified at the time of sign-up.

Activation and Billing Information To activate the Free Trial, you may be required to enter your billing information. Rest assured, you will not be charged until the Free Trial period has ended.

Automatic Renewal and Charges Upon completion of the Free Trial, your Subscription will automatically convert to a paid plan, and your payment method will be charged based on the Subscription plan you selected during sign-up. To avoid this, you must cancel the Subscription before the Free Trial period ends.

Usage and Limitations During the Free Trial, you may have access to a limited set of features or data volume. The limitations will be communicated to you at the beginning of the Free Trial period.

Termination and Modification of Free Trial Digital Maestro Pte. Ltd. reserves the right to terminate or modify the Free Trial at any time without prior notice, in compliance with Singapore's Consumer Protection (Fair Trading) Act and other applicable laws.

No Refunds Refunds do not apply to Subscription Services converted from a Free Trial, except where required under Singaporean consumer protection laws.

Data Retention and PDPA Compliance After the Free Trial ends, your data will be retained for a specified period in compliance with Singapore's Personal Data Protection Act (PDPA) and our Privacy Policy.

7. Subscription Fee Modifications

Notice of Changes Digital Maestro Pte. Ltd. reserves the right to modify the Subscription fees at any time. We will give you advance notice of these changes, and the new fees will become effective at the end of your current billing cycle. The notice period will be in compliance with Singapore’s Consumer Protection (Fair Trading) Act and Payment Services Act.

User Agreement to New Fees Your continued use of the Subscription Services after the effective date of the fee change will be considered as your agreement to the modified Subscription fees. If you do not agree with the changes, you have the right to discontinue your Subscription before the change becomes effective.

Promotional and Discount Offers From time to time, we may offer promotional pricing or discounts. These offers will be subject to additional terms and conditions which will be communicated to you at the time of the offer.

Currency and Taxes All Subscription fees are stated in Singapore Dollars (SGD) and are exclusive of Goods and Services Tax (GST). Any applicable GST will be calculated and charged at the time of billing, in accordance with Singapore tax laws.

Downgrades and Upgrades If you change your Subscription plan, the new fees will be applicable immediately. In the case of downgrades, no refunds will be issued for the unused portion of the higher Subscription plan. Upgrades will be prorated based on the remaining period of your current Subscription cycle.

Payment Failures Should automatic billing fail for any reason, we will issue an electronic invoice indicating that you must proceed manually to complete the payment. Failure to complete payment within the given timeframe may result in the suspension or termination of your Subscription Services.

Legal Compliance All fee modifications and billing procedures will adhere to Singapore’s Consumer Protection (Fair Trading) Act, Payment Services Act, and other applicable laws, ensuring that we maintain a transparent and lawful pricing strategy.

8. Refund Policy

Right to Refund In accordance with Singapore's Consumer Protection (Fair Trading) Act, Digital Maestro Pte. Ltd. offers a refund policy that allows you to request a full or partial refund within fourteen (14) calendar days of the original purchase of the Contract or Subscription, unless otherwise stated.

Exceptions to Refunds Not all services or products may be refundable. Exceptions could include but are not limited to: Digital products that you have started to download or stream.
Services that have already been fully performed.
Products or services clearly personalized to your needs.
Process for Requesting a Refund.
To initiate a refund, you must email support@digitalmaestro.com with your request, providing all necessary details related to your purchase, such as order number and reason for the refund. We will process your request within seven (7) business days and inform you of the outcome via email.

Refund Method Refunds will be processed using the same method of payment used for the original transaction, unless you have explicitly agreed otherwise. In case the original payment method is no longer available, an alternative method will be used.

Timeframe for Refund Once approved, the refund will be processed within fourteen (14) business days and may take additional time to appear in your account, depending on your bank’s processing time.

Termination of Services In cases where a refund is approved, any ongoing or future services associated with the refunded amount may be terminated or suspended.

Compliance with Laws Our refund policy is in compliance with Singapore’s Consumer Protection (Fair Trading) Act, the Payment Services Act, and other applicable laws, ensuring fairness and transparency.

9. Fair Usage Policy

Objective To maintain high-quality service and fairness among all our users, Digital Maestro Pte. Ltd. implements a Fair Usage Policy (FUP). The FUP is aligned with Singapore's
Telecommunications Act and is designed to prevent any exploitation of our services that can adversely affect the experience for other users.

Scope The FUP applies to all services and products offered by Digital Maestro Pte. Ltd. It covers usage limits, acceptable conduct, and the consequences of policy violations.

Usage Limitations While we strive to offer unlimited or high-usage allowances on many of our services, certain limitations may apply to prevent abuse. These limitations are based on statistical data related to average usage and are aimed at offering equitable access to our services for all users.

Monitoring and Enforcement We actively monitor usage patterns to identify any unusual or excessive activities. In case your usage significantly exceeds the average usage of other customers, we reserve the right to: Send a warning email indicating excessive usage.
Temporarily throttle or limit service features.
Suspend or terminate your account in extreme cases.
Violations and Consequences.

Usage that violates our FUP includes but is not limited to automated scraping of our web pages, spamming, and unauthorized reselling of our services. Violation of the FUP could lead to temporary or permanent suspension of your account, as per Singapore's Personal Data Protection Act (PDPA) and other applicable laws.

Dispute Resolution If you believe that your usage is compliant with our FUP and wish to dispute any action taken against your account, you can email support@digitalmaestro.com for a review. All disputes will be handled in accordance with Singapore’s Dispute Resolution Code of Practice.

Policy Revisions Digital Maestro Pte. Ltd. reserves the right to change the FUP at any time. Changes will be communicated via email or through announcements on our website.

Legal Compliance This Fair Usage Policy is in compliance with the relevant laws and regulations in Singapore, including the Telecommunications Act and the Personal Data Protection Act (PDPA).

10. User-Generated Content

Your Responsibilities When using Digital Maestro Pte. Ltd.’s services, you may post, upload, or otherwise contribute content such as text, graphics, videos, and other material ("User Content"). You are solely responsible for any User Content you provide, including its legality and appropriateness. When posting User Content, you affirm that you own the rights to it or have acquired the appropriate permissions to use it.

Content Licensing to Digital Maestro Pte. Ltd. By submitting User Content, you grant Digital Maestro Pte. Ltd. a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and distribute your User Content. This includes the rights to adapt, reformat, and create derivative works from your User Content to improve our services or promote the company. Your Content may be displayed across all platforms and services operated by Digital Maestro Pte. Ltd., unless otherwise stated in writing.

Compliance with Singapore Law All User Content should adhere to Singapore’s Internet Code of Practice, governed by the Infocomm Media Development Authority (IMDA). Offensive content, hate speech, or material that violates Singapore's laws on racial and religious harmony will result in immediate account termination.

Monitoring and Removal of Content While Digital Maestro Pte. Ltd. is not obligated to monitor User Content, we reserve the right to review and remove content that violates our Terms of Service, Fair Usage Policy, or any applicable laws in Singapore, including the Personal Data Protection Act (PDPA).

Data Collection and Privacy Any data derived from User Content will be treated according to our Privacy Policy and in compliance with Singapore's PDPA. We may use aggregated, non-identifiable data for analytics and service improvement.

Intellectual Property Rights You retain any intellectual property rights on the User Content you submit, subject to the license you grant us. Any infringement claims related to copyrighted material will be dealt with according to Singapore’s Copyright Act.

Disclaimer Digital Maestro Pte. Ltd. is not responsible for any third-party content posted on our platforms. Our role is that of an intermediary service provider as defined under Singapore's Electronic Transactions Act.

11. Prohibited Conduct and Usage Policy

Lawful Usage Digital Maestro Pte. Ltd.'s services must be used in compliance with all applicable laws and regulations in Singapore. This includes, but is not limited to, the Computer Misuse and Cybersecurity Act, the Sedition Act, and the Protection from Harassment Act. Any unlawful activities will result in immediate account termination.

Ethical and Respectful Conduct Users are expected to maintain a high standard of ethical conduct while using our services. Activities that incite hatred, violence, or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age are strictly prohibited. Any content that contravenes Singapore's Maintenance of Religious Harmony Act or Racial Harmony Act will be subject to immediate action.

Responsible Data Usage Users are responsible for ensuring that their data usage complies with the Personal Data Protection Act (PDPA) of Singapore. This includes, but is not limited to, the collection, usage, and disclosure of personal data.

Commercial and Financial Activities If you are using our services for commercial purposes, you must adhere to Singapore's Consumer Protection (Fair Trading) Act and the Payment Services Act. This includes providing accurate information about products or services and using secure and compliant methods for transactions.

Intellectual Property Users must respect intellectual property rights and must not engage in activities that violate copyrights, patents, or trademarks. Any such violations will be dealt with in accordance with Singapore's Intellectual Property Act.

System Integrity Users are prohibited from engaging in activities that compromise the integrity of our systems. This includes distributing malware, conducting denial-of-service attacks, or attempting to gain unauthorized access to our services or another user’s account.

Reporting Violations If you encounter content or behavior that you believe violates these terms, please report it to us immediately at support@digitalmaestro.com. Failure to report known violations may result in actions being taken against your account.

Penalties for Violations Violations of this policy may result in a range of actions, including but not limited to warnings, account suspensions, or legal actions in accordance with Singapore law.

12. Data Analytics and Third-Party Service Providers

Analytics Partners We may collaborate with third-party analytics providers to help us understand how our services are being used. These providers may use cookies, device identifiers, and similar technologies to collect data about your usage.

13. Use by Minors

14. Account Management

Account Creation To maximize the benefits of our services, you may be required to create an account with Digital Maestro Pte Ltd. By creating an account, you agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Confidentiality and Security You are responsible for maintaining the confidentiality of your account password and are fully responsible for all activities that occur under your account. Digital Maestro Pte Ltd cannot and will not be liable for any loss, damage, or other liability arising from your failure to comply with this section or from any unauthorized access to or use of your account.

Account Termination We reserve the right to deactivate or terminate your account at our sole discretion, including for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for other reasons. Deactivation or termination may result in the forfeiture and destruction of all information associated with your account.

Data Retention and Deletion In accordance with Singapore's Personal Data Protection Act (PDPA), we will retain your account information for as long as your account is active or as needed to provide you services. Should you request to deactivate your account, your account data will be deleted in accordance with our data retention policy.

Notifications and Alerts By creating an account, you agree to receive notifications, alerts, and updates which are integral to the services provided. These may include but are not limited to payment authorizations, password changes, and confirmation messages. Opting out of such communications may impact the services provided.

Account Recovery In case of a forgotten password or compromised account, you should immediately contact our support team at support@digitalmaestro.com. We will assist in recovering your account, which may include identity verification procedures.

Monitoring and Auditing We reserve the right to monitor and audit accounts for the purpose of ensuring compliance with these terms, to investigate discrepancies, and to safeguard the integrity of our services.

15. Intellectual Property Rights

Ownership and Rights The content, features, and functionality of the Digital Maestro platform, including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof, are owned by Digital Maestro Pte Ltd, its licensors, or other providers of such material and are protected by Singapore and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limited License Subject to your compliance with these Terms, Digital Maestro Pte Ltd grants you a limited, non-exclusive, non-transferable, non-sub-licensable license to access and use the services offered. Except as expressly permitted in these Terms, you may not: copy, modify or create derivative works based on the services; distribute, transfer, sublicense, lease, lend, or rent the services to any third party; reverse engineer, decompile, or disassemble the services; or make the functionality of the services available to multiple users through any means.

User-Generated Content You may be able to upload, store, publish, display, and distribute information, text, photos, videos, and other content on or through the service ("User Content"). User Content includes any content posted by you or by users of any of your account(s). You are solely responsible for any and all User Content that is posted through your account on the service. You warrant that you own all rights to the User Content and have the right to grant Digital Maestro Pte Ltd a worldwide, royalty-free, non-exclusive license to exploit it in any way in connection with the provision of our services.

Third-Party Intellectual Property By using the service, you agree not to upload, post, or otherwise transmit any matter or views that are protected by copyright, patent, trademark, trade secret, or other proprietary rights of a third party, including but not limited to, the unauthorized copying of copyrighted material or any other form of intellectual property infringement.

Infringement Policies Digital Maestro Pte Ltd respects the intellectual property rights of others and expects users to do the same. In the event of any infringement of such rights, we will respond promptly to any proper notice of infringement and will take appropriate actions under the Intellectual Property Laws of Singapore, including the removal or disabling of access to the infringing material.

Trademarks The names, logos, and all related product and service names, design marks, and slogans are the trademarks or service marks of Digital Maestro Pte Ltd or its affiliates or licensors. You are not authorized to use any such marks for any purpose without the prior written consent of Digital Maestro Pte Ltd.

Attribution and Feedback Digital Maestro Pte Ltd may use, reproduce, and display User Content in connection with the marketing, demonstration, and operation of its services. Any feedback, comments, or suggestions you may provide regarding the service is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

Issue Reporting and Support Should you encounter any issues, bugs, or other discrepancies while using Digital Maestro's services, we encourage you to promptly report these through our dedicated support channels. Feedback Submission Your feedback is important for the continuous improvement of our services. You may provide suggestions, observations, or other forms of feedback ("Feedback") through our designated platforms. By submitting Feedback, you grant Digital Maestro Pte Ltd the non-exclusive, royalty-free, worldwide, transferable, sub-licensable right and license to use, disclose, and otherwise exploit the Feedback for any purpose, without any obligation or compensation to you.

Effect of Termination Upon termination, all licenses and other rights granted to you by these Terms of Service will immediately cease. Any data stored by us may be deleted, and we are not responsible for the loss of such data.

Arbitration If a dispute cannot be resolved through mediation, the parties agree to submit the dispute to the Singapore International Arbitration Centre (SIAC), in accordance with the Arbitration Rules of the Singapore International Arbitration Centre ("SIAC Rules") for the time being in force.

Class Action Waiver Both you and Digital Maestro Pte Ltd agree that any disputes will be arbitrated only on an individual basis and not as a class action. This class action waiver is an essential part of our arbitration agreement and may not be severed. If for any reason this class action waiver is found unenforceable, then the entire arbitration agreement will not apply.

Opt-Out Right You have the right to opt out of binding arbitration within 30 days of the date you first accepted these Terms by writing to support@digitalmaestro.com. In order to be effective, the opt-out notice must include your full name and address and clearly indicate your intent to opt out of binding arbitration.
